What Makes a Will
Valid in BC

You must be at least 16

BC's Wills, Estates and Succession Act (WESA) allows anyone 16 or older to make a valid will. Younger individuals can only make a will if they are married, in a domestic partnership, or a member of the Canadian Forces.

It must be in writing

A BC will can be typed or printed — there's no requirement for it to be handwritten. Holograph wills (entirely handwritten and signed) are technically valid under WESA but carry significant risk and are not recommended.

It must be signed by you

You must sign at the end of the will, or direct someone else to sign in your presence if you are physically unable to. Your signature shows the will reflects your final wishes.

Two witnesses must sign

Two witnesses must be present when you sign and must sign the will in your presence. Witnesses should not be beneficiaries or the spouses of beneficiaries — gifts to a witness may be void under WESA.

It should be reviewed after major life events

Under WESA, marriage revokes a prior will unless the will was made in contemplation of that marriage. Separation does not automatically revoke gifts to a former spouse. Review your will after every major life change.
